Terms of Use

The undersigned Buyer, including any person or entity related to Buyer or who in any manner acts on buyer's behalf to acquire property, hereby grants to The Holcomb Corporation at Seascape Resort a one year exclusive right to represent Buyer on any purchase of real property located at 1 Seascape Resort Drive, Aptos CA 95003. As the exclusive, on-site real estate brokerage at Seascape Resort, it may be necessary or appropriate for Broker to act as an agent for both a buyer and a seller, exchange party, or one or more additional parties. Broker shall disclose to Buyer any election to act as a dual agent representing both Buyer and Seller. If Buyer is shown property listed by Broker, Buyer consents to Broker acting as a dual agent. In such event, Buyer agrees that Broker will not disclose to Seller that Buyer is willing to pay a price greater than the price offered. Broker, without the prior consent of Seller, will not disclose to Buyer that Seller is willing to sell property at a price less than the listing price, and a dual agent is obligated to disclose known facts materially affecting the value or desirability of the property to both parties. Buyer further understands that other buyers may consider, make offers on, or acquire the same or similar properties as those Buyer is seeking to acquire. Buyer consents to Broker's representation of such other potential Buyers before, during, and after the representation period. Buyer further agrees to pay Broker compensation as offered by Seller on MLS Listings, Inc., or as otherwise negotiated, but in no event less than 1% of the purchase price. Broker shall be entitled to compensation if Buyer enters into an agreement with Seller to acquire property at Seascape Resort, and closes escrow or otherwise completes a real property condominium purchase with title of the Seascape property transferred into the Buyer's name.
